These Terms of Use ("Terms") govern your access to and use of the Flitfast website and data migration platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old and authorized to act on behalf of your organization to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2. Use of the Service
You agree to use the Service only for lawful purposes. You will not:
- Migrate data you do not have the right to access or transfer;
- Attempt to reverse engineer, disrupt, or gain unauthorized access to the Service;
- Use the Service to store or transmit unlawful, infringing, or malicious content.
3. Your data and responsibilities
You retain all rights to the data you migrate. You are responsible for ensuring you have the necessary rights and consents to transfer that data and for reviewing field mappings before executing a migration. While Flitfast provides hash-based validation and one-click rollback, you are responsible for verifying results in your destination systems.
4. Fees and payment
Pricing is based on the volume of data moved rather than per-record fees. Estimates generated by our calculator are illustrative and not binding. Final fees are confirmed in a written quote. Fees are due as set out in your order and are non-refundable except as required by law.
5. Service availability
We strive to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.
6. Intellectual property
The Service, including all software, design, and content (excluding your data), is owned by Flitfast and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
7. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind to the maximum extent permitted by law. To the fullest extent permitted by law, Flitfast will not be liable for indirect, incidental, or consequential damages, and our aggregate liability is limited to the fees you paid for the Service in the twelve months preceding the claim.
8. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, provisions that by their nature should survive will continue to apply.
9. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction over any disputes arising from them.
